Conditions of Use

General

1. The owner of this web site is Mac and More Ltd. Our trading address is Studio 5, Carpenters Buildings, Carpenters Lane, Cirencester, Gloucestershire, GL7 1EE. We can be contacted by phone on 01285 643255.

2. Use of this site is restricted to the authorised credit or debit card holder of any orders only. Mac and More Ltd are not responsible for any orders or usage by unauthorised card users.

3. You undertake that all details you provide to us for the purpose of ordering or purchasing goods or services are correct and that the credit or debit card you are using is your own and that there are sufficient funds to cover the cost of the goods or services ordered.

4. We will communicate primarily via e-mail. You agree to the use of e-mail as our primary method of communication.

Processing of orders

1. Payment for in stock items will be taken at time of order. Orders will be dispatched with due consideration for timeliness. Usually this will mean the same working day if orders are received before 12.00 midday, or the following day in the case of orders received after midday. Sometimes delays may occur due to circumstances beyond our control which will result in a delay. In this case items will be dispatched as soon as is practically possible and in any case within 10 days.

2. Should dispatch of goods not be possible within 10 working days, a full refund will be made for both the cost of the item and postage. Mac and More Ltd's liability in this respect will amount only to the amount of the order including any postage and insurance. Costs incurred by the customer as a result of delayed postage are not the responsibility of Mac and More Ltd.

3. We will confirm all order by e-mail prior to dispatch. You should check that the details on this confirmatory e-mail are correct as soon as possible and you should print out and keep a copy of it.

4. Mac and More Ltd will not pass on your personal or credit or debit card details to any third party except where an additional security check may be deemed necessary. We may hold and use your data in accordance with the terms of our Privacy Policy.

5. Mac and More are not responsible for any changes in your order that you fail to communicate to us prior to dispatch of your order.

6. Other than as outlined in our terms and conditions above all purchases are non-exchangeable, non-refundable and non-transferable.

7. Every purchase you make shall be deemed performed in the United kingdom. The laws of England shall govern every aspect of contractual agreement concerning purchases made from the Site.

Returns

1. You may cancel your order at any time prior to order dispatch. You may also cancel your order after you have received your order providing you inform us within 7 working days after you receive the product by (in the case of prior to receipt of order) sending the notice of cancellation by email quoting your name, address and order reference number; or (in the case of having received your order) returning the goods to our offices unopened together with the original invoice.

2. Mac and More Ltd. will refund the full purchase price of the goods minus any shipping costs or additional customs duties which shall be borne by the customer.

3. Once we receive notification from you that you wish to cancel your order (in accordance with these terms), the relevant part of any sum debited to mac and More Ltd from your credit or debit card will be re-credited to that credit card account as soon as possible and in any event within 30 days of your order. All goods to be returned should be received by us in the condition that they were in when delivered.

4. Should any parts be ordered in error Mac and More Ltd reserves the right to make a 20% or £15 (whichever is greater) charge for restocking. Upon receipt of returned goods, a refund of the original purchase price of the part minus the restocking fee will be made to the customer. We reserve the right to refuse to accept the return of new products which the customer purchased in error and which have been opened. We also reserves the right to make a charge for collecting goods from your premises in circumstances where they are not defective but you have cancelled your order. Your statutory rights are not affected.

Liability

1.This section applies only to the extent permitted by law. Mac and More Ltd do not exclude or limit any liability for

(a) personal injury (including sickness and death) where such injury results from Mac and More Ltd's negligence or wilful default, or that of our employees, agents or subcontractors or

(b) fraudulent misrepresentation.

2. Mac and More Ltd does not accept liability (except as set out below) for any errors and omissions and reserve the right to change information, prices, specifications and descriptions of listed goods, products and services at our discretion.

3. If an error is discovered in the price of the goods that you have ordered, we will inform you as soon as possible. In the event that you order an item and the price published on the Site is incorrect for any reason, we will contact you to let you know the correct price and ask you whether you still wish us to fulfil your order at this price. We shall be under no obligation to fulfil an order for a product which was advertised at an incorrect price. We shall give you the option of confirming the order at the correct price or if you so choose, to cancel the order altogether. If you cancel and have already paid for the goods in the circumstances described in this clause, we shall refund the full amount in accordance with these Terms.

4. Mac and More Ltd will do its best to correct errors and omissions as quickly as practicable after being notified of them.

5. MAC AND MORE LTD DOES NOT REPRESENT OR WARRANT THAT THE INFORMATION ACCESSIBLE VIA THIS SITE IS ACCURATE, COMPLETE OR CURRENT. TO THE FULLEST EXTENT PERMITTED BY LAW, MAC AND MORE LTD IS PROVIDING THIS SITE AND ITS CONTENTS ON AN ‘AS IS’ BASIS AND MAKES NO (AND EXPRESSLY DISCLAIMS ALL) REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, WITH RESPECT TO THIS SITE OR THE INFORMATION, CONTENT, MATERIALS OR PRODUCTS INCLUDED IN THIS SITE INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

6. NOTHING IN THIS CLAUSE AFFECTS YOUR STATUTORY RIGHTS. In the event that you receive goods which were not what you ordered or which are damaged or defective, or are of a different quantity to that stated on your order form, Mac and More Ltd shall, at its own option, make good any shortage or non-delivery, replace or repair any damaged or defective goods, or refund to you the amount you paid for the goods in question PROVIDED THAT you notify us of the problem in writing or via e-mail at the address stated in the confirmation e-mail within 10 working days of delivery of the goods.

7. You and Mac and More Ltd will only be liable under these Terms for losses which are a reasonably foreseeable consequence of the relevant breach of contract.

8. Mac and More Ltd do not accept liability for any indirect loss, consequential loss, loss of data, loss of income or profit, loss of damage to property and/or loss from claims of third parties arising out of the use of the Site or for any products or services purchased from the Site. Use of products or services purchased from this site in a commercial environment are strictly at the customers own risk.

9. All new electrical products are covered by a twelve month manufacturer´s warranty. If your product develops a fault while under warranty, please contact us and we will advise you where to send it for repair. It is a "return to base" warranty therefore there will be a delivery charge to return the product back to the relevant UK service centre.

10. Mac and More Ltd. shall not be held liable for any loss of income or data that results from the failure of any part that is under a manufacturers warranty. Where replacement of a part incurs fitting and delivery costs these costs shall, at Mac and More Ltd's discretion be borne by the customer.

Delivery/title/risk

1. Title to any product ordered will pass to you once Mac and More Ltd has received payment in full for that product. Risk in any product ordered will pass upon delivery to you.

2. If your delivery address is outside of the United Kingdom, you may be subject to import duties and taxes, which are levied once a shipment reaches your country. Any such additional charges for customs clearance must be borne by you. You should note that customs policies vary widely from country to country, we advises each customer to contact their local customs office for further information. Please note that when shipping products internationally, you should be aware that cross-border shipments are subject to opening and inspection by customs authorities.

Couriers and Shipping

1. All items packaged by customers for return or computers packaged for fitting are the responsibility of the customer until signed for by the courier company or postal service.

2. Responsibility for adequate packaging of all inwardly couriered companies lies with the customer.

3. All inward courier deliveries are covered in transit by our designated courier companies. The details of these terms and conditions are available on the relevant courier companies web site. Mac and More Ltd's liability for loss or damage shall be limited as outlined by these terms and conditions. Should you not agree with the courier company terms and conditions your only remedy is not to hand items to the courier for delivery. All items accepted for delivery by the courier company shall be deemed to have accepted these terms and conditions.

4. All and any claims arising out of loss or damage during delivery shall be be the responsibility of the courier company.

5. All orders (and returning fitted items) are the responsibility of the relevant courier company upon collection from Mac and More Ltd. Any claims for loss or damage should be made in respect of the relevant courier company.

Miscellaneous

1. We shall have no liability to you for any delay in the delivery of products ordered or any other matters to the extent that the delay is due to any event outside our reasonable control, including but not limited to acts of God, war, flood, fire, labour disputes, strikes, lock-outs, riots, civil commotion, malicious damage, explosion, governmental actions and any other similar events.

2. We shall have no liability (including liability for negligence) for the acts or omissions of telecommunications service providers or for failures of, or faults in their networks and equipment.

3. No waiver by us of any breach of these Terms shall be considered as a waiver of any subsequent breach of the same or any other provision.

4. You may not permit, create unauthorized framing of, or deep linking to, the Site or the creation of derivative works thereof from any other website under your management or control. In these Terms, ‘Intellectual Property Rights’ means patents, database rights, copyright, design rights (whether registered or unregistered), trade marks (whether registered or unregistered) and other similar rights, together with the right to apply for the protection of any such rights. All Intellectual Property Rights in the Site shall be owned by us absolutely.

5. Subject to the licence granted to you to use the Site, we reserve all rights, title and interest in its Intellectual Property Rights in the Site. Any goodwill accruing from use of the Site and its affiliates’ trade marks, trade and business names and service marks under this Agreement will vest in mac and More Ltd and its affiliates, as appropriate.

6. It is a crime to use a false name or a known invalid credit card to order. Anyone caught wilfully entering an erroneous or fictitious order will be prosecuted to the fullest extent of the law. Our order processing company tracks every order placed on the Site to enable the appropriate authorities to engage in anti fraud activities.

7. We reserve the right to terminate this Agreement and to suspend or terminate access to the Site immediately and without notice to you if:
i. you fail to make any payment to us when due;
ii. you breach the terms of this Agreement (repeatedly or otherwise);
iii. when requested by us to do so, you fail to provide us within a reasonable time with sufficient information to enable us to determine the accuracy and validity of any information supplied by you, or your identity;
iv. we suspect you have engaged, or about to engage, or have in any way been involved, in fraudulent or illegal activity on the Site.

8. We may amend these Terms from time to time, and place the new version on the Site. For users purchasing goods or registering on the Site for the first time, all purchases from the date that the amended terms are placed on our website onwards will be governed by those new terms Otherwise, such changes will be effective against existing users thirty days following posting of the amended version on the Site.

9. Your continued use of the Site following our posting of any changes will constitute your acceptance of such changes. If you do not agree to any changes to these Terms, then your only remedy is to cease using the Site.

10. These Terms supersede any and all other conditions, understandings, commitments, agreements or representations (except fraudulent misrepresentations) relating to your purchase, whether oral or in writing, and contain the entire agreement between Mac and More Ltd and you relating to your purchase. We advise that you print off and keep safe a copy of these terms and conditions once your order has been accepted by Tus. You are advised to read (and are responsible for reading) fully all information on this website.

11. If any provision of these Terms shall be held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the remaining parts of these Terms and the remainder of the affected provision shall be unaffected.

12. These Terms are subject to the laws and exclusive jurisdiction of England.
